Terms of Service

The agreement that governs your use of FingerprintIQ. Please read it carefully.

1. Acceptance of these Terms

These Terms of Service (the “Terms”) are a binding agreement between you (“you”, “Customer”) and FingerprintIQ (“FingerprintIQ”, “we”, “us”). By creating an account, installing an SDK, calling our API, or otherwise using the Service you agree to these Terms and to our Privacy Policy. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of the Service

FingerprintIQ provides device fingerprinting, bot and agent classification, Sybil-resistance signals, wallet enrichment, and related dashboards and APIs (collectively, the “Service”). We may add, modify, or remove features from time to time. Material changes that adversely affect a paid plan will be communicated with reasonable notice.

3. Accounts, API keys, and security

You are responsible for everything that happens under your account and API keys. Keep secret keys secret — treat them like passwords. You must:

  • Provide accurate registration information and keep it current.
  • Use strong authentication (we strongly recommend enabling MFA).
  • Notify us promptly at info@fingerprintiq.com of any suspected compromise.
  • Not share a single account between humans who don’t belong to the same organization.

4. Acceptable use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party right.
  • Target, harass, surveil, stalk, dox, or discriminate against any individual or protected class.
  • Identify or de-anonymize individuals for political surveillance, military targeting, or law-enforcement purposes outside your own product’s fraud and abuse workflows.
  • Reverse engineer, decompile, or attempt to extract source code or model weights from the Service (except where this restriction is prohibited by applicable law).
  • Use the Service to build or train a directly competing fingerprinting or bot-detection product.
  • Probe, scan, or test the vulnerability of any system or network without authorization.
  • Submit data you don’t have the right to submit, or that infringes intellectual property, privacy, or confidentiality.
  • Send malicious code, spam, or content that is illegal, defamatory, or sexually explicit involving minors.
  • Resell or sublicense the Service without our written consent.

We may suspend or terminate access immediately if we reasonably believe you are violating this section.

5. Plans, payment, and refunds

Paid plans are billed in advance on a monthly or annual basis and are non-refundable except as required by law. Usage above your plan’s included quota is billed at the overage rate published on the pricing page at the time of consumption. We may change pricing on 30 days’ notice; changes apply at the start of your next billing period.

If you cancel, your subscription remains active until the end of the current billing period. You can downgrade or upgrade at any time — proration is applied to upgrades.

6. Data ownership

You own all data you submit to the Service (“Customer Data”) and all outputs the Service generates from that data on your behalf. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and display Customer Data solely to provide and improve the Service, subject to our Privacy Policy.

We may use aggregated, de-identified data derived from Customer Data to improve our classifiers and publish industry-level statistics. Aggregated data will never identify you or your end-users.

7. Intellectual property

FingerprintIQ retains all right, title, and interest in and to the Service, including the SDKs, dashboards, APIs, models, documentation, and brand. No licence is granted to you except for the limited, revocable right to use the Service in accordance with these Terms. Feedback you provide is licensed to us perpetually and without restriction.

8. Third-party services

The Service integrates with third-party services (OAuth providers, on-chain RPCs, payment processors, etc.). Your use of those services is governed by their own terms and we are not responsible for them.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. FingerprintIQ produces probabilistic signals; you are responsible for the decisions you make based on those signals.

10. Limitation of liability

To the maximum extent permitted by law, in no event shall FingerprintIQ or its affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to these Terms or the Service, even if advised of the possibility of such damages. FingerprintIQ’s aggregate liability for all claims arising out of or related to these Terms shall not exceed the greater of (a) the amounts you paid to FingerprintIQ in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

11. Indemnification

You will defend, indemnify, and hold harmless FingerprintIQ, its affiliates, officers, and employees from and against any third-party claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of (a) your Customer Data, (b) your use of the Service in violation of these Terms or applicable law, or (c) your products or services offered to your end-users.

12. Suspension and termination

You may terminate your account at any time from the dashboard. We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay, or use the Service in a way that creates a security, legal, or reputational risk. On termination, your right to use the Service stops immediately. Sections that by their nature should survive termination (ownership, fees owed, disclaimers, liability, indemnity, governing law) will survive.

13. Changes to the Terms

We may update these Terms from time to time. We will post the updated version here and, for material changes, notify account owners by email. Continued use of the Service after a change takes effect means you accept the updated Terms. If you do not accept the changes, your sole remedy is to stop using the Service.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware for any dispute that is not subject to arbitration or small-claims jurisdiction. The UN Convention on Contracts for the International Sale of Goods does not apply.

15. Miscellaneous

These Terms, together with the Privacy Policy and any order form, are the entire agreement between you and us regarding the Service. If a provision is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
